BELLUM – Terms of Service

These Terms of Service (“Terms”) form a binding agreement between Astarte Industries Inc. (“Astarte,” “we,” “our,” or “us”) and the individual or entity that purchases, downloads, installs, or plays BELLUM (“you” or “Player”). By completing a purchase, creating an account, installing our launcher, or accessing any part of the Game, you agree to be bound by these Terms. If you do not accept every provision, do not purchase, download, or play BELLUM.

2. Account Registration & Security

1. Required Account. You must create an Astarte account, redeem your game key, and log in through our launcher to access any portion of the Game.
2. Accuracy. All registration information must be true, accurate, and current.
3. Security. You are solely responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately of any unauthorized use.
4. Non-Transferable. Accounts, keys, and Perks are personal to you and may not be sold, transferred, or otherwise shared.

3. Purchases, Pre-orders & Limited Editions

1. Global Sales; Regional Pricing. The Game is sold worldwide through the Merchant of Record. Regional discounts may be restricted to the country or territory where you make the purchase; VPNs or other circumvention techniques are prohibited.
2. Limited Quantities. Certain Editions or Perks are offered only while supplies last on a first-come, first-served basis. We make no guarantee of availability.
3. Perk Specificity. Each Edition’s Perks are listed at the point of sale. Perks marked “pre-order exclusive” expire when the Pre-order Period ends.
4. Right to Correct Errors. We may refuse, correct, or cancel orders (including confirmed orders) if pricing or availability information is inaccurate.

4. Access Stages & Content Delivery

1. Eligibility. Access to closed-alpha and closed-beta is determined solely by the Edition purchased; higher tiers may receive earlier access.
2. Staged Waves. We may enable access in waves to manage server load. Timing of each wave is at our discretion.
3. Notification & Delivery. We will email the address you provided with your key and download instructions. Delivery is deemed complete when we transmit that email.
4. No Resale. Keys and access rights may not be resold or advertised for resale.

5. Refund Policy

Refunds are requested through Paddle (or a future payment processor we designate). Fraud, charge-back abuse, or violation of these Terms voids refund eligibility.

6. Age Requirements

1. Minimum Age. You must be 13 years or older to create an account or play BELLUM.
2. Minors. If you are 13–17, you represent that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
3. Parental Controls. We reserve the right to implement age- and content-verification measures as required by law.

7. Servers & Online Service

1. Astarte Servers. BELLUM is multiplayer-only and requires a continuous online connection to our servers.
2. No Guaranteed Uptime. Server availability, quality of service, and uptime are not guaranteed. We may modify, limit, or discontinue servers at any time, with or without notice.
3. Service Duration. We will maintain official servers while commercially reasonable; however, we may cease support if operation becomes impracticable or financially nonviable.
4. Third-Party Servers. Unofficial servers are currently prohibited. If we permit third-party servers, additional terms will apply.

8. Prohibited Conduct

You agree not to:

• • Cheat, exploit, reverse engineer, modify, or distribute unauthorized software that interacts with the Game (including any anti-cheat circumvention).
• • Harass, threaten, or abuse other Players.
• • Use offensive, hateful, or illegal user names or content.
• • Attempt to gain unauthorized access to accounts, servers, or networks.
• • Use VPNs or similar to evade regional pricing, bans, or other restrictions.
• • Commercially exploit the Game, account, or Perks without our prior written consent.

Violation may result in immediate suspension or termination of your account without refund.

9. Intellectual Property & License

1. Ownership. BELLUM, the launcher, all assets, and all related intellectual property are owned by Astarte and are protected by copyright, trademark, and other laws.
2. License Grant. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, personal license to download, install, and play the Game for your own non-commercial entertainment.
3. Restrictions. You may not copy, distribute, publicly perform, display, or create derivative works from the Game except as expressly permitted.
4. Feedback. Any feedback you provide is non-confidential and may be used by us without compensation or obligation.

10. Data Collection & Privacy

   • • Account information (e-mail, username, payment confirmation)
   • • Gameplay data and telemetry
   • • Chat logs and anti-cheat information
2. Purpose. We use this data to operate and improve the Game, administer anti-cheat measures, provide customer support, and send marketing communications (where lawful).
3. Sharing. Data may be shared with Paddle, anti-cheat vendors, analytics providers, and cloud-hosting partners, each bound by appropriate safeguards.
4. Privacy Policy. Additional details are set out in the BELLUM Privacy Policy, incorporated herein by reference.
5. Your Rights. Where applicable, you may exercise rights under GDPR, CCPA, or other data-protection laws by following the instructions in our Privacy Policy.

11. Disclaimers & Limitation of Liability

1. AS IS / AS AVAILABLE. THE GAME AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
2. No Guarantee. We do not guarantee uninterrupted or error-free operation, compatibility with your hardware, or that defects will be corrected.
3. Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASTARTE, ITS AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY AMOUNT EXCEEDING THE FEES YOU ACTUALLY PAID FOR THE GAME.
4. Jurisdictional Limits. Some jurisdictions do not allow certain warranty exclusions or liability limitations; in those regions, our liability will be limited to the minimum extent allowed by law.

12. Indemnity

You agree to indemnify, defend, and hold harmless Astarte, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of or related to:

• • your breach of these Terms;
• • your misuse of the Game; or
• • your violation of any law or third-party right.

13. Amendments

We may update these Terms from time to time. Material changes will be communicated via e-mail or in-launcher notice at least 48 hours before they take effect. Continued use of the Game after the effective date constitutes acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

1. Law. These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law provisions.
2. Venue. Any dispute that is not resolved informally will be litigated exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to personal jurisdiction and waive any objections to venue or forum non conveniens.
3. Opt-Out of Class Actions. YOU AND ASTARTE AGREE TO LITIGATE ONLY ON AN INDIVIDUAL BASIS; CLASS OR COLLECTIVE ACTIONS ARE NOT PERMITTED.

15. Termination

We may suspend or terminate your account, license, or access to servers at any time for violation of these Terms, suspected fraud, or to comply with legal obligations. Sections 8–15 survive termination.

16. Miscellaneous

• Entire Agreement. These Terms (plus any policies incorporated by reference) constitute the entire agreement between you and Astarte.
• Severability. If any provision is held unenforceable, the remainder will remain in effect.
• No Waiver. Our failure to enforce any right or provision is not a waiver of future enforcement.
• Assignment. You may not assign these Terms without our prior written consent; we may assign freely as part of a merger, acquisition, or sale of assets.
